Terms and Conditions — B77 Media (Motorsports & Sports)
These Terms and Conditions govern the provision of photography and videography services by B77 Media ("the Photographer") for motorsport and sporting events, persons or team. By booking services with B77 Media, the Client agrees to be bound by the terms outlined below.
1. Booking and Payment
1.1 A 50% non-refundable deposit is required to secure any booking.
1.2 The remaining balance must be paid before any photos or videos are delivered.
1.3 Final deliverables will be provided no later than the agreed deadline after the event.
1.4 All quotes are subject to change unless confirmed with a signed agreement and deposit.
2. Scope of Services
2.1 B77 Media will provide professional photo and/or video services for the Client’s motorsport or sporting event, as outlined in the booking agreement.
2.2 Coverage may include, but is not limited to: on-track action, gameplay, team areas, warm-up or pit/paddock zones, athlete or driver portraits, team branding, celebrations, and other event-related content.
2.3 B77 Media is not responsible for reduced coverage caused by schedule changes, weather, red flags, rule restrictions, or safety limitations.
3. Creative Direction and Style
3.1 The Client acknowledges familiarity with B77 Media’s style and agrees to the Photographer’s creative discretion regarding shot selection, editing style, colour grading, music selection, pacing, and overall production.
3.2 Final deliverables may vary depending on event conditions, access limitations, or environmental factors.
3.3 Requests for major re-edits, style changes, or additional alterations may incur extra fees at B77 Media’s discretion.
4. Venue Rules and Restrictions
4.1 B77 Media will comply with all venue, club, league, team, or promoter regulations, including restrictions on flash usage, drone operation, or access to certain areas.
4.2 The Client understands these restrictions may impact the final deliverables and agrees that no refund or partial refund will be provided as a result.
5. Conduct and Safety
5.1 The safety of B77 Media staff is the highest priority. All team members, athletes, officials, and guests must treat B77 Media personnel respectfully.
5.2 In cases of harassment, unsafe conditions, abuse, or threats, B77 Media may immediately withdraw services without refund.
5.3 The Client may not interfere with or obstruct photography or videography during the event.
6. Liability and Force Majeure
6.1 B77 Media will take reasonable measures to ensure successful service delivery but is not liable for:
Technical failures (memory card issues, equipment malfunction, etc.)
Environmental factors (weather, lighting, delays, red flags, cancelled matches/sessions)
Injuries or property damage occurring during the event
6.2 If the Photographer experiences illness, injury, or an emergency and no replacement is available, a full refund will be issued.
6.3 Partial refunds may be considered if only part of the event is affected due to circumstances outside B77 Media’s control.
7. Delivery and File Storage
7.1 Final files will be delivered digitally (or by another agreed method) within the agreed timeframe, typically within 2 weeks of the event.
7.2 The Client is responsible for downloading, saving, and backing up the delivered files.
7.3 B77 Media is not responsible for lost or corrupted files after delivery. Re-delivery may be offered at the Photographer’s discretion but is not guaranteed.
8. Copyright and Usage Rights
8.1 All images and videos created by B77 Media remain the exclusive intellectual property of B77 Media.
8.2 The Client is granted a non-exclusive, non-transferable license for personal use, promotional use, or internal team/business use.
8.3 The Client must ensure they have proper permissions for any music, branding, or logos supplied for editing purposes.
9. Cancellation and Rescheduling
9.1 The 50% deposit is strictly non-refundable.
9.2 Bookings may be transferred subject to availability and B77 Media’s approval.
9.3 A $20 cancellation fee applies for cancellations within 24 hours of the event.
9.4 If post-production has already begun, the Client remains responsible for those costs.
9.5 Failure to pay cancellation fees within 5 days may result in recovery or legal action.
10. Credit and Attribution
10.1 When publishing or sharing B77 Media content, the Client agrees to:
Clearly credit B77 Media
Tag @B77Media on social media platforms where applicable
Not apply filters or modifications that misrepresent the work
10.2 Failure to credit appropriately may result in revoked usage rights.
11. Non-Disparagement
11.1 The Client agrees not to publish false, misleading, or defamatory statements about B77 Media or its team.
11.2 Concerns or disputes must be communicated directly with B77 Media before posting publicly.
12. Agreement
By making a booking and/or payment, the Client confirms they have read, understood, and agreed to these Terms and Conditions.
